Welcome to Fireweed AI. These Terms of Use ("Terms") govern your access to and use of our website at fireweedai.ca (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. Please read them carefully. If you do not agree, please do not use the Site.

Fireweed AI ("Fireweed AI," "we," "our," or "us") is an Indigenous-led, federally incorporated Canadian company headquartered in Whitehorse, Yukon.

1. Eligibility and authority

By using the Site, you confirm that you are the age of majority in your jurisdiction, or that you have the legal capacity and authority to agree to these Terms. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" includes that organization. You agree to use the Site only for lawful purposes and in compliance with all applicable laws.

2. Relationship to our products and services

The Site provides information about Fireweed AI and the Sovereign Institutional Intelligence System (SIIS). It is not the product itself. Access to and use of any SIIS instance, demo environment, or other Fireweed AI service is governed by a separate written agreement between Fireweed AI and the relevant institution. In the event of any conflict between these Terms and such an agreement with respect to a product or service, that agreement governs for that product or service.

3. Acceptable use

You agree not to:

• use the Site in any way that violates applicable law or these Terms;

• attempt to gain unauthorized access to the Site, our systems, or any data;

• interfere with or disrupt the integrity, security, or performance of the Site;

• introduce malicious code, or use the Site to transmit unlawful, harmful, or infringing content;

• scrape, harvest, or collect information from the Site by automated means without our prior written consent; or

• misrepresent your identity or affiliation.

We may investigate and take appropriate action against any conduct that we reasonably consider a violation of these Terms or applicable law.

4. Intellectual property

All content on the Site — including text, images, logos, graphics, designs, and software — is the property of Fireweed AI or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted, you may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

"Fireweed AI," "SIIS," and our logos are trademarks of Fireweed AI. Other names and marks referenced on the Site — including OCAP®, a registered trademark of the First Nations Information Governance Centre, and the CARE Principles, a framework of the Global Indigenous Data Alliance — are the property of their respective owners and are referenced for descriptive purposes only.

5. Your submissions and feedback

If you choose to send us feedback, suggestions, or testimonials through the Site, you grant Fireweed AI a non-exclusive, royalty-free, worldwide licence to use that feedback to operate and improve our products, services, and communications. This licence covers general feedback and suggestions only. It does not apply to any confidential, proprietary, culturally significant, or community-owned information — such materials must not be submitted through the Site and are governed exclusively by a separate written agreement with us. We will not publish your name or organization in a testimonial without your consent.

6. Disclaimer of warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied. While we strive to provide accurate and current information, we do not warrant that the content is accurate, complete, reliable, or error-free, or that the Site will be uninterrupted or secure. Statements on the Site about products, capabilities, or roadmap are informational and do not form part of any agreement unless expressly incorporated into a signed contract.

7. Limitation of liability

To the fullest extent permitted by law, Fireweed AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from or related to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Third-party links

The Site may contain links to third-party websites. These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content, products, or practices of any third-party site, and your use of those sites is at your own risk and subject to their terms.

9. Suspension and termination

We may suspend or terminate your access to the Site at any time, with or without notice, if you violate these Terms or engage in conduct we reasonably consider harmful to our business, our users, or others. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

10. Changes to these Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. We will post the updated version here with a revised "Last updated" date. Your continued use of the Site after an update takes effect means you accept the revised Terms.

11. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the Yukon and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be resolved in the courts located in the Yukon, and you consent to the jurisdiction of those courts.

12. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy and any separate written agreement governing our products or services, constitute the entire agreement between you and Fireweed AI regarding the Site.
